Costa Rica's Constitutional Chamber (Sala IV) ruled in 1988 that criminalising drug consumption violates Article 21 of the Constitution (right to personal freedom and self-determination). This ruling was a pioneering constitutional protection of drug use as a personal liberty — predating Portugal's legislative decriminalisation by 13 years. However, the ruling protects consumption and arguably possession for personal use, not purchase or supply, which remain criminal under the Ley General de Salud and Ley de Psicotrópicos. Legislative proposals to regulate cannabis have been introduced but not yet enacted as of 2026.
What Travellers Need to Know
San Jose is the capital and largest city of Costa Rica, a country celebrated for its biodiversity, ecological leadership and stable democracy. Cannabis tourism exists but is informal and unregulated. The constitutional protection of consumption means that for a tourist caught with a personal amount, prosecution is genuinely unlikely. However, the purchase transaction is not covered by the constitutional protection, and the absence of a licensed retail market means any purchase involves the informal supply chain. The enforcement culture is relaxed compared to most of Central America.
San Jose, Costa Rica Neighbourhood Guide
La Californica (Barrio California) is San Jose's bohemian arts and cafe district, home to galleries, independent restaurants and the most cannabis-adjacent social scene. Barrio Amon is a Victorian-era neighbourhood with boutique hotels and a relaxed culture. La Sabana is a park area with adjacent sports culture. Escazu is an upscale suburb. San Pedro near the University of Costa Rica has student culture and cannabis visibility. The city centre (Avenida Central) is commercial and not cannabis-relevant. Beach areas (Manuel Antonio, Guanacaste, Puerto Viejo) have even more relaxed enforcement cultures than San Jose.
Safety Tips for San Jose, Costa Rica
Costa Rica is one of the most genuinely cannabis-tolerant destinations in the Americas for travellers, due to the constitutional protection. Exercise standard discretion: consume privately, do not purchase in large quantities, and avoid combining cannabis with other substances in public spaces. Do not take cannabis across Costa Rica's borders into Nicaragua or Panama, which have significantly stricter laws.
