Cannabis Laws in Warsaw 2026
Poland's drug framework is the Act on Counteracting Drug Addiction (2005 as amended). Cannabis possession for personal use is a criminal offence carrying up to 3 years imprisonment. A significant amendment (Article 62a) added in 2011 allows prosecutors to waive proceedings for possession of insignificant amounts intended solely for personal use. This is not decriminalisation — it is prosecutorial discretion. The waiver is applied inconsistently, is not guaranteed for foreign nationals, and still results in a drug offence record if processed. Medical cannabis was legalised in 2017 for prescription patients. Recreational legalisation has broad popular support but no near-term legislative pathway.
What Travellers Need to Know
Warsaw is Poland's capital and a growing tourist and business destination. Its Praga district and student areas have visible cannabis culture. The informal market exists but is less visible than in Berlin or Prague. Polish attitudes toward cannabis are mixed: younger urban Poles are broadly liberal but the political environment under successive conservative governments has not moved toward reform. The Article 62a waiver means some tourists with small amounts are released with a warning, but this is not consistent and cannot be relied upon.
Warsaw Neighbourhood Guide
Praga (right bank of the Vistula) is Warsaw's most authentic working-class and now increasingly gentrifying district, with galleries, bars and a cannabis presence. Powiśle along the river embankment has outdoor bar culture in summer. Srodmiescie (City Centre) is commercial and central. Mokotow is residential and affluent. Ochota near the university is student-oriented. The Old Town is a UNESCO heritage tourist area where cannabis use would be highly visible and inappropriate.
Safety Tips for Warsaw
The legal risk is real. Article 62a provides a possibility of waiver but not certainty. Legal CBD products are available in Warsaw from specialist shops. If you choose to consume THC cannabis in Warsaw, do so only in private accommodation, with minimal quantities, and be prepared for the possibility of genuine criminal proceedings. Poland is reforming slowly; the situation may change but has not changed yet. For regional comparison, Prague and Berlin are nearby and have markedly better frameworks.
