Malaga and the broader Costa del Sol fall under Spanish national cannabis law, the same framework as Barcelona and Madrid. Personal possession and use in private is decriminalised since 1992. The Public Safety Act (Ley Mordaza) 2015 governs public consumption: fines range from 601 to 30,000 euros, with the lower range (601–10,401 euros) typical for personal amounts in public. Cannabis Social Clubs operate under Spanish association law as private, member-only, non-commercial organisations. Cultivating cannabis in visible spaces is prohibited; private indoor cultivation for personal use is in a grey zone.

Malaga is Andalusia's largest city and the gateway to the Costa del Sol. Its cannabis scene has grown significantly in recent years with the expansion of Cannabis Social Clubs into southern Spain. The city's large expat community (particularly British) and year-round tourist population have shaped a relatively open informal market.
