Cannabis Legal Status in Malaysia

Malaysia enforces some of the world's harshest cannabis laws under the Dangerous Drugs Act 1952. Cannabis is classified as a Class A dangerous drug with no legal recreational, medical, or social-club framework. The law applies identically to Malaysian citizens and visiting foreign nationals. The death sentence by hanging has been carried out on foreign nationals convicted of drug trafficking in Malaysia.

Under Section 39B of the Dangerous Drugs Act, possession of 200 grams or more of cannabis creates an irrebuttable legal presumption of drug trafficking. This means a tourist carrying what might be a personal supply in their home country automatically faces a capital charge in Malaysian courts. As of 2023, Malaysia announced reforms to allow some judicial discretion in capital drug cases, but the legal risk remains extreme.
